1. Agreement to Terms

These Terms of Use (“Terms”) form a binding agreement between you (“Merchant”) and Fundlify UG (“Fundlify,” “we,” “us,” or “our”), governing your access to and use of the Fundlify Shopify application (“the App”). By installing or using the App, you confirm that you have read, understood, and agree to these Terms, as well as the Shopify Partner Program Agreement and Shopify Acceptable Use Policy (AUP) which are incorporated herein by reference.

2. Description of the App

Fundlify is a Shopify plugin that enables merchants to run crowdfunding-style pre-order campaigns directly on their Shopify store. Fundlify is a software provider only; we are not a payment processor, fulfillment partner, or escrow service. All transactions are processed through your Shopify store via your designated payment gateway (e.g., Shopify Payments/Stripe).

3. Eligibility

To use the App, you must be at least 18 years old and operate a Shopify store in good standing. You must ensure that your business model and products comply with the laws of your jurisdiction and the jurisdictions of your customers.

4. Merchant Responsibilities & Compliance

You are solely responsible for campaign content, product quality, and fulfillment. You specifically represent and warrant that:

• Your campaign does not violate any third-party rights or intellectual property.
• You will strictly adhere to the Shopify Acceptable Use Policy (AUP).
• You will not use Fundlify to bypass or circumvent the restricted business terms of your payment processor (e.g., Stripe’s Restricted Business list).

5. Acceptable Use & Prohibited Content

To maintain the integrity of the App and our standing as a Shopify Partner, Fundlify prohibits the use of the App for campaigns involving:

• Adult Content: Including but not limited to sexually explicit material, pornography, or erotic digital/physical media (NSFW).
• Illegal/Regulated Goods: Gambling, weapons, controlled substances, or tobacco.
